�

Ready-mixed concrete trucks often face challenges complying with outdated axle and tire load restrictions that do not account for the unique operational requirements of these vehicles. This can result in inefficiencies, increased operational costs, and potential penalties for truck operators. The current regulations do not align with modern federal standards or industry practices, creating unnecessary barriers for businesses transporting ready-mixed concrete.

This Bill Would:

� Amend the Transportation Code to update weight and tire load restrictions for ready-mixed concrete trucks, aligning them with current federal standards;

� Authorize trucks to operate with tandem axle weights of up to 46,000 pounds and single axle weights of up to 23,000 pounds;

� Allow ready-mixed concrete trucks to have a gross weight of up to 69,000 pounds or the maximum allowable weight under the federal bridge gross weight formula; and

� Require that tire load ratings not be exceeded to maintain safety and prevent infrastructure damage.

As proposed, S.B. 1394 amends current law relating to weight and tire load restrictions for the operation of a vehicle transporting ready-mixed concrete on a public highway.

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends the heading to Section 622.012, Transportation Code, to read as follows:

Sec. 622.012.� WEIGHT AND TIRE LOAD RESTRICTIONS.

SECTION 2.� Amends Section 622.012(a), Transportation Code, as follows:

(a)� Authorizes a ready-mixed concrete truck to be operated on a public highway of this state only if:

(1)� the truck's tandem axle weight, or the weight of a group of axles that does not exceed nine feet, is not heavier than 46,000 pounds;

(2) �the truck's single axle weight is not heavier than 23,000 pounds;

(3)� the truck's gross weight is not heavier than the greater of 69,000 pounds or� the truck's maximum allowable weight under the formula established in Section 621.101 (Maximum Weight of Vehicle or Combination); and

(4)� the load rating of the truck's tires is not exceeded.

Makes a nonsubstantive change to this subsection.

SECTION 3. Effective date: upon passage or September 1, 2025.
