AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

On February 28, 2025, the Comal County Juvenile Probation Board unanimously passed a resolution in favor of changing the statutorily required composition of the juvenile board. C.S.S.B. 1790 reflects the board's wishes and reduces the number of board members from nine to seven to control the size of the Juvenile Board as the number of courts increases due to population growth.

 

Key Provisions:

 

As introduced, the bill would have reduced the board to five members.

 

Committee Substitute:

 

The substitute will reduce the board to seven members.

Additions to the Board:

         One elected judicial officer of Comal County, appointed by the local administrative county court judge; and

         Two elected judicial officers of Comal County, appointed by the local administrative district court judge.

 

Removals from the Board:

         Judge of the 433rd District Court;

         Judge of the 274th District Court;

         Judge of the 207th District Court;

         Judge of the 22nd District Court; and

         Judges from each county court at law in the county.

 

C.S.S.B. 1790 amends current law relating to the composition of the Comal County Juvenile Board.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 152.0521(a), Human Resources Code, as follows:

 

(a) Provides that the Comal County Juvenile Board is composed of certain officials, including the local administrative statutory county court judge, an elected judicial officer of Comal County appointed by the local administrative statutory county court judge, the local administrative district judge, and two elected judicial officers of Comal County appointed by the local administrative district judge. Deletes existing text providing that the composition of the Comal County Juvenile Board includes the judge of each county court at law in the county, the judge of the 22nd District Court, the judge of the 207th District Court, the judge of the 433rd District Court, and the judge of the 274th District Court. Makes nonsubstantive changes.

 

SECTION 2. Effective date: September 1, 2025.
