AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Residential treatment centers (RTCs) provide supervision and care for children with serious emotional disorders. As part of the application for a license to operate a residential treatment center, a prospective licensee must submit a proposed operational plan to the Health and Human Services Commission (HHSC), including a plan for providing for the resident children's education, as required by Section 42.252(c), Human Resources Code.

 

S.B. 2311 strengthens the current educational planning requirements for RTC license applicants to require a written agreement between the RTC and the school that will be educating the resident children prior to the RTC becoming operational, including regarding important logistical factors, such as where educational services will be provided and how the children will be transported to that location. 

 

As proposed, S.B. 2311 amends current law relating to the requirements for the operational plan for certain general residential operations licensed by the Health and Human Services Commission.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 42.252(c), Human Resources Code, to require that the general residential operation's proposed operational plan include an educational plan describing the applicant's plan to provide for the educational needs of the children at the general residential operation that includes certain provisions, including a written agreement, rather than any discussions, plans, and agreements, with the local school district, private school, or local charter school that will be providing education to the school-age children at the operation that includes information about the location where education services will be provided and the transportation of children to that location.

 

SECTION 2.� Effective date: September 1, 2025.
