AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
S.B. 2367 adds Waller County into the section of code that will allow their parks department to enforce park rules in order to deter the misuse of public facilities and save taxpayer funds. Subject to the approval of the county commissioners court, the board of park commissioners may adopt reasonable rules concerning park use. A violation of these rules will be subject to a civil penalty.
As proposed, S.B. 2367 amends current law relating to the authority of certain counties to enact certain park use rules.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Sections 320.0455(a) and (b-1), Local Government Code, as follows:
(a) Provides that Section 320.0455 (Rules in Certain Counties; Penalty for Violations) applies only to a county with population of:
(1) makes no changes to this subdivision;
(2)-(3) makes nonsubstantive changes to these subdivisions; or
(4) less than 75,000 that is adjacent to three counties with populations of more than 450,000.
(b-1) Prohibits a board created for a county described by Subsection (a)(2) (relating to a county with a population of 800,000 or more that is adjacent to a county with a population of 2.8 million or more) or (a)(4) from adopting rules relating to the use of fireworks.
SECTION 2. Effective date: September 1, 2025.
