AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Road rage incidents pose serious dangers not only to the aggressor and the victim, but also to other motorists�especially when a firearm is involved.

 

S.B. 3031 expands the definition of "aggravated assault" to include incidents in which an individual is inside of or directly en route to or from a motor vehicle and discharges a firearm�causing bodily injury to any person, property damage, or placing any person in fear of imminent serious bodily injury. An offense under this bill would be punishable as a second-degree felony.

 

As proposed, S.B. 3031 amends current law relating to the punishment for the offense of aggravated assault.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 22.02(b), Penal Code, as follows:

 

(b) Provides that an offense under Section 22.02 (Aggravated Assault) is a felony of the second degree, except that the offense is a felony of the first degree if certain conditions are met, including if the actor is inside of or directly en route to or from a motor vehicle, rather than if the actor is in a motor vehicle, as defined by Section 501.002 (Definitions), Transportation Code, and performs certain actions, including, in discharging a firearm, causing bodily injury, rather than serious bodily injury, to any person or damage to any property or placing any person in fear of imminent serious bodily injury. Makes nonsubstantive changes.

 

SECTION 2. Makes application of this Act prospective.

 

SECTION 3. Effective date: September 1, 2025.
