AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The expansion of the Creedmoor Municipal Utility District (district) is necessary to accommodate the annexation of five additional tracts of land, totaling approximately 145 acres, within the corporate limits of the City of Mustang Ridge and the City of Creedmoor in Travis County. Currently, the district serves essential water, sewer, drainage, parks, and road infrastructure to the area but needs to officially redefine its boundaries to include the newly annexed land.

 

S.B. 3033 would redefine the boundaries of the district to reflect the annexation of these five tracts. The bill would ensure that the district can continue to provide infrastructure and services to the expanded area, supporting both residential and commercial development in the Willow Springs project.

 

S.B. 3033 would streamline the process of extending services to the newly annexed land, improving service delivery and facilitating growth in the area. The City of Creedmoor and the City of Mustang Ridge have both consented to the legislation, and there is no known opposition to this local bill.

 

This utilizes the municipal utility district "template" approved by and used in prior sessions by the House and Senate Committees Council.

 

Notice of intent was given on February 4, 2025.

 

As proposed, S.B. 3033 amends current law relating to the boundaries of, and validating certain acts and proceedings of, the Creedmoor Municipal Utility District.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 7951A.0106, Special District Local Laws Code, as follows:

 

Sec. 7951A.0106. New heading: DISTRICT TERRITORY. (a) Provides that the Creedmoor Municipal Utility District (district) is composed, rather than initially composed, of the territory described by Section 2A, rather than Section 2 (relating to setting forth the initial boundaries of the district), of the Act enacting Chapter 7951A (Creedmoor Municipal Utility District).

 

(b) Makes a conforming change to this subsection.

 

SECTION 2. Amends Chapter 762, Acts of the 87th Legislature, Regular Session, 2021, by adding Section 2A to set forth the boundaries of the district.

 

SECTION 3. Repealer: Section 2 (relating to setting forth the initial boundaries of the district), Chapter 762 (Creation of the Creedmoor Municipal Utility District; Granting a Limited Power of Eminent Domain; Providing Authority to Issue Bonds; Providing Authority to Impose Assessments, Fees, and Taxes), Acts of the 87th Legislature, Regular Session, 2021.

 

SECTION 4. (a) Provides that the legislature validates and confirms all governmental acts, elections, and proceedings of the Creedmoor Municipal Utility District that were taken before the effective date of this Act.

 

(b) Provides that this section does not apply to any matter that on the effective date of this Act is involved in litigation if the litigation ultimately results in the matter being held invalid by a final court judgment or has been held invalid by a final court judgment.

 

SECTION 5. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 6. Effective date: upon passage or September 1, 2025.
