BACKGROUND AND PURPOSE

 

The bill sponsor has informed the committee that Milam County, through a formal resolution, has requested authority to use a portion of groundwater export fees collected by the Post Oak Savannah Groundwater Conservation District to support county infrastructure improvements, specifically county roads, which are essential for both general public use and for the district's ability to access and inspect groundwater wells. S.B. 3058 seeks to address this issue by providing a clear legal mechanism for the district to partner with counties and direct funds toward mutually beneficial infrastructure and environmental projects.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS   

 

S.B. 3058 amends the Special District Local Laws Code to require the Post Oak Savannah Groundwater Conservation District to enter into an agreement with a county to make improvements or develop programs or infrastructure. The bill requires the agreement to be approved by a majority of the district's board of directors and renewed annually. The bill authorizes the district to use district export fees to improve county roads as necessary for the district to inspect wells registered with or permitted or monitored by the district and to develop environmental programs and infrastructure related to groundwater in the district.
