AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 3058 allows the Post Oak Savannah Groundwater Conservation District to use export fee revenues to fund county road improvements needed for well inspections and to support environmental programs and groundwater-related infrastructure. It requires formal agreements with counties, approved annually by the district's board. The purpose of S.B. 3058 is to enhance the district's ability to manage and protect groundwater resources effectively.

 

As proposed, S.B. 3058 amends current law relating to certain improvements made and programs developed by the Post Oak Savannah Groundwater Conservation District.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subchapter C, Chapter 8865, Special District Local Laws Code, by adding Section 8865.1025, as follows:

 

Sec. 8865.1025. IMPROVEMENTS FOR ROADS AND ENVIRONMENTAL PROGRAMS AND INFRASTRUCTURE. (a) Requires the Post Oak Savannah Groundwater Conservation District (district) to enter into an agreement with a county to make improvements or develop programs or infrastructure under this section. Requires that the agreement be approved by a majority of the board of directors of the district and renewed annually.

 

(b) Authorizes the district to use export fees authorized under Section 8865.151(c) (relating to authorizing the district to impose a reasonable fee or surcharge for an export fee using certain methods) to improve county roads as necessary for the district to inspect wells operated by the district and develop environmental programs and infrastructure related to groundwater in the district.

 

SECTION 2. Amends Section 8865.151(d), Special District Local Laws Code, to authorize fees authorized by Section 8865.151 (Fees) to be assessed annually, used to pay the cost of operating the district, and used as provided by Section 8865.1025 and to make nonsubstantive changes.

 

SECTION 3. Effective date: September 1, 2025.
