A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the maintenance of certain improvements associated with |
|
|
oil and gas development and production; authorizing an |
|
|
administrative penalty. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 91, Natural Resources |
|
|
Code, is amended by adding Section 91.021 to read as follows: |
|
|
Sec. 91.021. MAINTENANCE OF CERTAIN IMPROVEMENTS. (a) An |
|
|
operator of a well drilled for oil or gas shall maintain in |
|
|
accordance with rules adopted by the commission all land and |
|
|
infrastructure that is: |
|
|
(1) associated with operations incident to oil and gas |
|
|
development production; and |
|
|
(2) located between the wellhead and a highway, as |
|
|
defined by Section 366.003, Transportation Code. |
|
|
(b) If the commission determines that a person has violated |
|
|
a rule adopted under this section, the commission shall assess a |
|
|
penalty against the person in the manner provided by Sections |
|
|
81.0532 through 81.0534 for assessing an administrative penalty |
|
|
under Section 81.0531. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
