A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of certain counties to regulate recycling |
|
|
businesses. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 234, Local Government |
|
|
Code, is amended by adding Section 234.0025 to read as follows: |
|
|
Sec. 234.0025. REGULATION OF RECYCLING BUSINESSES. (a) |
|
|
This section applies only to a county: |
|
|
(1) in which a municipality with a population of |
|
|
500,000 or more is located; and |
|
|
(2) that is located on an international border. |
|
|
(b) The commissioners court of a county to which this |
|
|
section applies by order may regulate the operation of a recycling |
|
|
business located in the unincorporated area of the county. |
|
|
(c) A commissioners court may not include in an order |
|
|
adopted under this section a requirement that conflicts with a |
|
|
similar requirement prescribed by another law governing a recycling |
|
|
business, including a requirement prescribed by Chapter 396, |
|
|
Transportation Code. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2025. |
