A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the admissibility of certain hearsay statements in the |
|
|
prosecution of certain sexual or assaultive offenses committed |
|
|
against a child or person with a disability. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 2, Article 38.072, Code of Criminal |
|
|
Procedure, is amended by adding Subsection (a-1) to read as |
|
|
follows: |
|
|
(a-1) This article applies to an individual's statement |
|
|
that meets the requirements of Subsection (a), regardless of the |
|
|
age of the individual at the time the statement was made. |
|
|
SECTION 2. The change in law made by this Act applies to a |
|
|
criminal proceeding that commences on or after the effective date |
|
|
of this Act. A criminal proceeding that commences before the |
|
|
effective date of this Act is governed by the law in effect on the |
|
|
date the proceeding commenced, and the former law is continued in |
|
|
effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
