A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to requiring public schools to provide to certain parents |
|
notice regarding certain incidents and risks related to the |
|
parent's child and suicide prevention materials. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 37.0832, Education Code, is amended by |
|
adding Subsections (c-2) and (c-3) to read as follows: |
|
(c-2) The procedure for providing notice to a parent or |
|
guardian of an alleged victim of an incident of bullying under |
|
Subsection (c)(4) must include requirements to: |
|
(1) maintain a record that verifies the parent or |
|
guardian was notified of the incident; and |
|
(2) provide the parent or guardian with: |
|
(A) suicide prevention materials; and |
|
(B) information on ways to limit the student's |
|
access to means of committing suicide, including a firearm or |
|
medication. |
|
(c-3) The agency, in coordination with the Health and Human |
|
Services Commission, shall select the materials and information |
|
described by Subsection (c-2)(2). |

SECTION 2. Section 38.351, Education Code, is amended by |
|
adding Subsections (e-1) and (e-2) to read as follows: |
|
(e-1) The board of trustees of a school district or the |
|
governing body of an open-enrollment charter school shall adopt a |
|
policy that establishes a procedure for providing notice in |
|
addition to any notice provided in accordance with Subsection |
|
(e)(3) to a parent or guardian of a student who is identified as at |
|
risk of suicide. The procedure must include requirements to: |
|
(1) maintain a record that verifies the parent or |
|
guardian was notified regarding the risk; and |
|
(2) provide the parent or guardian with: |
|
(A) suicide prevention materials; and |
|
(B) information on ways to limit the student's |
|
access to means of committing suicide, including a firearm or |
|
medication. |
|
(e-2) The agency, in coordination with the Health and Human |
|
Services Commission, shall select the materials and information |
|
described by Subsection (e-1)(2). |
|
SECTION 3. This Act applies beginning with the 2025-2026 |
|
school year. |
|
SECTION 4. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2025. |
