A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the operation of school buses at certain railroad grade |
|
|
crossings. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Sections 545.2535(c) and (d), Transportation |
|
|
Code, are amended to read as follows: |
|
|
(c) An operator is not required to stop at: |
|
|
(1) an abandoned railroad grade crossing that is |
|
|
marked with a sign reading "tracks out of service"; [or] |
|
|
(2) an industrial or spur line railroad grade crossing |
|
|
that is marked with a sign reading "exempt[.]"; or |
|
|
(3) a railroad grade crossing with active warning and |
|
|
control devices, including both a functioning gate and flashing |
|
|
light. |
|
|
(d) A sign under Subsection (c)(1) or (2) may be erected |
|
|
only by or with the consent of the appropriate state or local |
|
|
governmental official. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
