A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the process for filling a vacancy on the board of |
|
|
certain property owners' associations. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 209.00593(a), Property Code, is amended |
|
|
to read as follows: |
|
|
(a) Notwithstanding any provision in a dedicatory |
|
|
instrument, any board member whose term has expired must be elected |
|
|
by owners who are members of the property owners' association. |
|
|
If [A board member may be appointed by the board to fill] a vacancy |
|
|
occurs on the board, the board shall order a special election to |
|
|
fill the vacancy. A board member elected [appointed] to fill a |
|
|
vacant position shall serve until the next regular election of |
|
|
members to the board [for the remainder of the unexpired term of the |
|
|
position]. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
