A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the regulation by the Texas Commission on Environmental |
|
|
Quality of certain outdoor burns conducted during a state of |
|
|
disaster or state of emergency. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 382.018, Health and Safety Code, is |
|
|
amended by adding Subsection (h) to read as follows: |
|
|
(h) The commission may not require notification to or |
|
|
authorization from a commission regional office as a prerequisite |
|
|
for conducting a controlled outdoor burn of combustible plant |
|
|
growth in a county in which a state of disaster or state of |
|
|
emergency has been declared by the governor or the president of the |
|
|
United States, unless the declaration expressly prohibits all |
|
|
outdoor burning. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
