A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to reporting the number of children known or reasonably |
|
believed to not be citizens of the United States enrolled in a |
|
public school and to requesting reimbursement from the United |
|
States government for the cost of educating those children. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 25.001, Education Code, is amended by |
|
adding Subsections (k), (l), and (m) to read as follows: |
|
(k) A school district shall include in the district's Public |
|
Education Information Management System (PEIMS) report, in the |
|
manner and form prescribed by commissioner rule, the number of |
|
persons admitted to the district under this section whom the |
|
district knows or reasonably believes to not be citizens of the |
|
United States. Nothing in this subsection authorizes a school |
|
district to deny admission to any person who is eligible under |
|
Subsection (b). |
|
(l) The commissioner shall annually submit to the United |
|
States government a request that the United States government |
|
reimburse the state for the cost of educating the total number of |
|
persons reported under Subsection (k) by all school districts. |
|
(m) The commissioner shall adopt rules as necessary to |
|
implement Subsections (k) and (l), including rules to ensure that |
|
information reported under those subsections does not contain |
|
personally identifiable information of a student. |
|
SECTION 2. This Act applies beginning with the 2025-2026 |
|
school year. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2025. |
