A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to certificates of convenience and necessity for the |
|
|
construction, ownership, or operation of facilities for the |
|
|
transmission of electricity. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 37.056, Utilities Code, is amended by |
|
|
adding Subsection (j) to read as follows: |
|
|
(j) The commission may not grant a certificate to build, |
|
|
own, or operate a facility that enables power to be imported into or |
|
|
exported out of the ERCOT power grid if the effect of the granted |
|
|
certificate would place facilities within the ERCOT power region |
|
|
under the jurisdiction of the Federal Energy Regulatory Commission. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
