A BILL TO BE ENTITLED

AN ACT
|
|
relating to compensation for habilitation transportation services |
|
under the community living assistance and support services (CLASS) |
|
waiver program. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 546, Government Code, as effective April |
|
1, 2025, is amended by adding Subchapter J-1 to read as follows: |
|
SUBCHAPTER J-1. COMMUNITY LIVING ASSISTANCE AND SUPPORT SERVICES |
|
(CLASS) WAIVER PROGRAM |
|
Sec. 546.0472. HABILITATION TRANSPORTATION SERVICES. To |
|
the extent permitted by federal law, an individual who provides |
|
habilitation transportation services to a recipient under the |
|
community living assistance and support services (CLASS) waiver |
|
program is entitled to compensation for all time spent operating a |
|
motor vehicle in connection with transporting a recipient, |
|
including time spent returning a recipient's vehicle to a |
|
designated location without the recipient as a passenger. |
|
SECTION 2. If before implementing any provision of this Act |
|
a state agency determines that a waiver or authorization from a |
|
federal agency is necessary for implementation of that provision, |
|
the agency affected by the provision shall request the waiver or |
|
authorization and may delay implementing that provision until the |
|
waiver or authorization is granted. |
|
SECTION 3. This Act takes effect September 1, 2025. |
