A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the practice of pharmacy and the refusal to dispense |
|
|
prescriptions. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 562, Occupations Code, is amended by |
|
|
adding Section 562.058 to read as follows: |
|
|
562.058 REFUSAL TO DISPENSE A PRESCRIPTION |
|
|
A pharmacist may not substitute his or her personal judgment for |
|
|
the prescribing physician's medical judgment. The fact that a |
|
|
prescription is being made for an off-label purpose is not a valid |
|
|
basis to refuse to dispense a prescription. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2025. |
