A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the improvement of certain school campuses based on the |
|
construction or rehabilitation of certain low income housing |
|
developments in the attendance zone of those campuses. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 380, Local Government Code, is amended |
|
by adding Section 380.005 to read as follows: |
|
Sec. 380.005. REQUIRED MUNICIPAL FUNDING OF CERTAIN CAPITAL |
|
IMPROVEMENTS. (a) In this section, "development" has the meaning |
|
assigned by Section 2306.6702, Government Code. |
|
(b) This section applies only to land that is: |
|
(1) located in a county with a population of more than |
|
1.5 million and in which more than 75 percent of the population |
|
lives in a single municipality; and |
|
(2) annexed by a municipality under Chapter 43. |
|
(c) A municipality in which a development is being |
|
constructed or rehabilitated on land to which this section applies |
|
shall request from each independent school district with a campus |
|
whose attendance zone includes the development an impact study that |
|
evaluates the capital improvements necessary for the campus to |
|
reasonably accommodate the estimated increase in the number of |
|
students that will result from the development. |
|
(d) Notwithstanding any other law and based on the results |
|
of the impact study a municipality requests under Subsection (c), |
|
the municipality shall fund the capital improvements identified as |
|
necessary in that study. The capital improvements must be |
|
completed in the manner and based on the timeline agreed on by the |
|
municipality and independent school district. |
|
SECTION 2. Section 380.005, Local Government Code, as added |
|
by this Act, applies to the construction or rehabilitation of a |
|
development that is in progress on or after the effective date of |
|
this Act. |
|
SECTION 3. This Act takes effect September 1, 2025. |
