A BILL TO BE ENTITLED
 
AN ACT
  relating to creating the criminal offense of jugging.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 29, Penal Code, is amended by adding
  Section 29.04 to read as follows:
         Sec. 29.04.  JUGGING. (a)  A person commits an offense if,
  with the intent to commit theft of another person's money, the
  person:
               (1)  knowingly travels from a commercial business or
  financial institution, as defined by Section 201.101, Finance Code,
  on the same path or route as another person without substantially
  deviating from that path or route; and
               (2)  is in possession of two or more criminal
  instruments, as defined by Section 16.01.
         (b)  An offense under this section is a state jail felony,
  except that the offense is:
               (1)  a felony of the third degree if, during the
  commission of the offense, the actor commits an offense under
  Section 30.04; or
               (2)  a felony of the first degree if, during the
  commission of the offense, the actor commits an offense under
  Section 29.02.
         (c)  If conduct constituting an offense under this section
  also constitutes an offense under another section of this code, the
  actor may be prosecuted under either section or under both
  sections.
         SECTION 2.  This Act takes effect September 1, 2025.
