A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to creating the criminal offense of jugging. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 29, Penal Code, is amended by adding |
|
Section 29.04 to read as follows: |
|
Sec. 29.04. JUGGING. (a) A person commits an offense if, |
|
with the intent to commit theft of another person's money, the |
|
person: |
|
(1) knowingly travels from a commercial business or |
|
financial institution, as defined by Section 201.101, Finance Code, |
|
on the same path or route as another person without substantially |
|
deviating from that path or route; and |
|
(2) is in possession of two or more criminal |
|
instruments, as defined by Section 16.01. |
|
(b) An offense under this section is a state jail felony, |
|
except that the offense is: |
|
(1) a felony of the third degree if, during the |
|
commission of the offense, the actor commits an offense under |
|
Section 30.04; or |
|
(2) a felony of the first degree if, during the |
|
commission of the offense, the actor commits an offense under |
|
Section 29.02. |
|
(c) If conduct constituting an offense under this section |
|
also constitutes an offense under another section of this code, the |
|
actor may be prosecuted under either section or under both |
|
sections. |
|
SECTION 2. This Act takes effect September 1, 2025. |
