A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the operation of certain off-highway vehicles on |
|
|
certain roadways. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter D, Chapter 551A, Transportation Code, |
|
|
is amended by adding Section 551A.060 to read as follows: |
|
|
Sec. 551A.060. OPERATION OF CERTAIN OFF-HIGHWAY VEHICLES ON |
|
|
CERTAIN HIGHWAYS. (a) This section applies only to an off-highway |
|
|
vehicle that is: |
|
|
(1) a recreational off-highway vehicle equipped with |
|
|
side-by-side seating for the use of the operator and a passenger; or |
|
|
(2) a utility vehicle. |
|
|
(b) Notwithstanding any other provision of this subchapter, |
|
|
an operator may operate an unregistered off-highway vehicle |
|
|
described by Subsection (a) on a highway for which the posted speed |
|
|
limit is not more than 65 miles per hour if: |
|
|
(1) the highway is not an interstate or limited access |
|
|
highway; and |
|
|
(2) the vehicle displays a license plate issued under |
|
|
Section 551A.052. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2025. |
