A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the deadline for the Texas Department of Criminal |
|
|
Justice to take custody of certain persons confined in a county |
|
|
jail. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 499.1215(b), Government Code, is amended |
|
|
to read as follows: |
|
|
(b) The department shall take custody of a person awaiting |
|
|
transfer to the department following conviction of a felony and |
|
|
sentencing to death or to a term of imprisonment in the department |
|
|
or confinement in a state jail not later than the first [45th] day |
|
|
following the date on which all documents required by Sections 8(a) |
|
|
and (c), Article 42.09, Code of Criminal Procedure, have been |
|
|
certified as required by Section 8(b) of that article. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to the confinement of a person that occurs on or after the effective |
|
|
date of this Act, regardless of whether the requirements for |
|
|
transfer of the person to the Texas Department of Criminal Justice |
|
|
are completed before, on, or after that date. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
