A BILL TO BE ENTITLED

AN ACT
|

relating to a no-evidence motion for summary judgment. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 18, Civil Practice and Remedies Code, is |
|
amended by adding Subchapter E to read as follows: |
|
SUBCHAPTER E. DISMISSAL FOR LACK OF EVIDENCE |
|
Sec. 18.121. NO-EVIDENCE MOTION FOR SUMMARY JUDGMENT. A |
|
court shall consider all evidence on the record or otherwise before |
|
the court when ruling on a no-evidence motion for summary judgment. |
|
SECTION 2. The change in law made by this Act applies to a |
|
no-evidence motion for summary judgment that is pending in a trial |
|
court on the effective date of this Act or that is filed on or after |
|
the effective date of this Act. |
|
SECTION 3. This Act takes effect September 1, 2025. |
