A BILL TO BE ENTITLED
 
AN ACT
  relating to the members of a school district's local school health
  advisory council.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 28.004, Education Code, is amended by
  amending Subsection (d) and adding Subsections (d-3) and (d-4) to
  read as follows:
         (d)  The board of trustees shall appoint at least five
  members to the local school health advisory council. The board of
  trustees:
               (1)  shall ensure that:
                     (A)  a [A] majority of the members are [must be]
  persons who are parents of students enrolled in the district and who
  are not employed by the district;
                     (B)  a member described by Paragraph (A) serves [.
  One of those members shall serve] as chair or co-chair of the
  council; and
                     (C)  subject to Subsection (d-4), at least one
  member is a district high school student who has applied for the
  position; and
               (2)  [.  The board of trustees also] may appoint one or
  more members to the council [persons] from each of the following
  groups or a representative from a group other than a group specified
  under this subsection:
                     (A) [(1)]  classroom teachers employed by the
  district;
                     (B) [(2)]  school counselors certified under
  Subchapter B, Chapter 21, employed by the district;
                     (C) [(3)]  school administrators employed by the
  district;
                     (D) [(4)  district students;
               [(5)]  health care professionals licensed or certified
  to practice in this state, including medical or mental health
  professionals;
                     (E) [(6)]  the business community;
                     (F) [(7)]  law enforcement;
                     (G) [(8)]  senior citizens;
                     (H) [(9)]  the clergy;
                     (I) [(10)]  nonprofit health organizations; and
                     (J) [(11)]  local domestic violence programs.
         (d-3)  Before appointing a district high school student to
  serve on the local school health advisory council under Subsection
  (d)(1)(C), the board of trustees shall take reasonable steps to
  notify district high school students of the opportunity to serve on
  the council and of how to apply for the position, including by
  posting signs on district campuses in the cafeterias and other
  common areas frequently used by students.
         (d-4)  The board of trustees shall accept applications for
  the position for a district high school student on the local school
  health advisory council under Subsection (d)(1)(C) for as long as
  the position is vacant and appoint a member to the position as soon
  as practicable.
         SECTION 2.  This Act applies beginning with the 2025-2026
  school year.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2025.
