A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to county notification requirements for incomplete plat |
|
|
applications. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 232.0025, Local Government Code, is |
|
|
amended by amending Subsection (b) and adding Subsection (b-1) to |
|
|
read as follows: |
|
|
(b) If a person submits a plat application to the |
|
|
commissioners court that does not include all of the documentation |
|
|
or other information required by Subsection (a), the commissioners |
|
|
court or the county authority responsible for approving plats shall |
|
|
[, not later than the 10th business day after the date the |
|
|
commissioners court receives the application,] notify the |
|
|
applicant of the missing documents or other information not later |
|
|
than: |
|
|
(1) the 10th business day after the date the |
|
|
commissioners court receives the application; or |
|
|
(2) the 30th day after the date the commissioners |
|
|
court receives the application, if the county has a population less |
|
|
than 850,000. |
|
|
(b-1) The commissioners court or the county authority |
|
|
responsible for approving plats shall allow an applicant to timely |
|
|
submit the missing documents or other information for a plat |
|
|
application that does not include all of the documentation or other |
|
|
information required by Subsection (a). |
|
|
SECTION 2. Section 232.0025, Local Government Code, as |
|
|
amended by this Act, applies only to a plat application filed on or |
|
|
after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
