A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the processing of an application for an authorization |
|
|
to use a standard permit for a rock or concrete crushing facility. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 382.05195, Health and Safety Code, is |
|
|
amended by adding Subsection (l) to read as follows: |
|
|
(l) The commission shall give priority when processing |
|
|
applications for an authorization to use a standard permit under |
|
|
this section for a rock or concrete crushing facility to an operator |
|
|
who the commission determines: |
|
|
(1) has previously been authorized to use a standard |
|
|
permit under this section for a rock or concrete crushing facility; |
|
|
and |
|
|
(2) if the operator of the facility described by |
|
|
Subdivision (1) did not own the land on which the facility was |
|
|
located, reclaimed the land disturbed by the facility: |
|
|
(A) before the 180th day after the date the |
|
|
facility ceased operating; or |
|
|
(B) according to the terms of any lease agreement |
|
|
between the operator and the landowner. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
