A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of a property owners' association to |
|
|
regulate a property owner's display of political signs. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 259.002, Election Code, is amended by |
|
|
adding Subsection (f) to read as follows: |
|
|
(f) Unless a sign described by Subsection (b) is displayed |
|
|
in violation of a restrictive covenant permitted by this section, a |
|
|
property owners' association may not issue to the property owner |
|
|
displaying the sign any communication, including a letter, e-mail, |
|
|
or oral demand, purporting to restrict the sign's display. A |
|
|
property owner who receives a communication from a property owners' |
|
|
association issued in violation of this subsection may bring an |
|
|
action for injunctive relief under this subsection to enjoin the |
|
|
association from engaging in the practice. The court shall award |
|
|
reasonable attorney's fees to a property owner who prevails in an |
|
|
action under this subsection. |

|
SECTION 2. This Act takes effect September 1, 2025. |
