A BILL TO BE ENTITLED
 
AN ACT
  relating to analysis of and reports on customer response to
  conservation appeals in ERCOT.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter Z, Chapter 39, Utilities Code, is
  amended by adding Section 39.920 to read as follows:
         Sec. 39.920.  RESPONSE TO CONSERVATION APPEALS. (a) The
  independent organization certified under Section 39.151 for the
  ERCOT power region shall collect for each zip code in ERCOT
  information showing the response by retail electric customers in
  that zip code to conservation appeals issued by the independent
  organization.
         (b)  Notwithstanding any provision in Chapter 17, Section
  39.101, or Section 39.107:
               (1)  the independent organization certified under
  Section 39.151 for the ERCOT power region may request that an
  electric cooperative, municipally owned utility, retail electric
  provider, or transmission and distribution utility provide to the
  independent organization information to allow the independent
  organization to comply with Subsection (a); and
               (2)  in response to a request described by Subdivision
  (1), an electric cooperative, municipally owned utility, retail
  electric provider, or transmission and distribution utility shall
  provide the information to the independent organization.
         (c)  An electric cooperative, municipally owned utility,
  retail electric provider, or transmission and distribution utility
  may not provide individual retail electric customer usage data or
  personal information to the independent organization certified
  under Section 39.151 for the ERCOT power region in response to a
  request received under this section.
         (d)  The independent organization certified under Section
  39.151 for the ERCOT power region shall:
               (1)  at least quarterly publish on the independent
  organization's Internet website updated analyses of the response by
  retail electric customers in ERCOT to conservation appeals issued
  by the independent organization; and
               (2)  submit to the legislature an annual report
  summarizing the analyses published under Subdivision (1).
         SECTION 2.  This Act takes effect September 1, 2025.
