A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the line of succession of individuals to serve as |
|
|
commander-in-chief of the state military forces. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 437.002(b), Government Code, is amended |
|
|
to read as follows: |
|
|
(b) If the governor is unable to perform the duties of |
|
|
commander-in-chief, the successor to the governor's authority as |
|
|
provided by the state constitution or other state law [adjutant |
|
|
general] shall command the Texas military forces[, unless the state |
|
|
constitution or other state law requires the lieutenant governor or |
|
|
the president of the senate to perform the duties of governor]. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
