A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the waiver of certain examination requirements for |
|
certain applicants for an engineering license. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 1001.305, Occupations Code, is amended |
|
to read as follows: |
|
Sec. 1001.305. WAIVER OF EXAMINATION REQUIREMENT. (a) The |
|
board by rule may waive all or part of the examination requirement |
|
for an applicant for the issuance or reissuance of a license under |
|
this chapter. The board may not waive the requirement unless the |
|
board first determines that: |
|
(1) the applicant possesses sufficient qualifications |
|
to justify the waiver; and |
|
(2) issuing or reissuing the license to the applicant |
|
does not pose a threat to the public health, safety, or welfare. |
|
(b) The board shall waive the fundamentals of engineering |
|
examination requirement for an applicant for the issuance or |
|
reissuance of a license under this chapter, regardless of whether |
|
the applicant has previously failed a fundamentals of engineering |
|
examination in this state or another jurisdiction, if: |
|
(1) the applicant has engaged in the active practice |
|
of engineering for at least 15 years; |
|
(2) the board determines that issuing or reissuing the |
|
license to the applicant does not pose a threat to the public |
|
health, safety, or welfare; |
|
(3) the applicant requests a waiver in writing at the |
|
time the application is filed; and |
|
(4) the applicant meets the educational requirement of |
|
Section 1001.302(a)(1). |

SECTION 2. Section 1001.305, Occupations Code, as amended |
|
by this Act, applies only to an application for an engineering |
|
license that is filed on or after the effective date of this Act. An |
|
application that was filed before the effective date of this Act is |
|
governed by the law in effect on the date the application was filed, |
|
and the former law is continued in effect for that purpose. |
|
SECTION 3. This Act takes effect September 1, 2025. |
