A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the use of a high occupancy vehicle lane by certain |
|
|
operators of motor vehicles. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter I, Chapter 545, Transportation Code, |
|
|
is amended by adding Section 545.429 to read as follows: |
|
|
Sec. 545.429. USE OF HIGH OCCUPANCY VEHICLE LANE BY CERTAIN |
|
|
OPERATORS. (a) Subject to Subsection (b), a female operator of a |
|
|
motor vehicle who is pregnant or is a parent or legal guardian of |
|
|
another person is entitled to use any high occupancy vehicle lane in |
|
|
this state regardless of the number of occupants in the motor |
|
|
vehicle. |
|
|
(b) The entitlement provided by Subsection (a) does not |
|
|
apply if the Texas Department of Transportation receives notice |
|
|
from the United States Department of Transportation Federal Highway |
|
|
Administration that the use of a high occupancy vehicle lane as |
|
|
provided by Subsection (a) would result in the loss of federal |
|
|
highway funding or other punitive actions taken against this state |
|
|
due to noncompliance with federal laws, regulations, or policies. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
