A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the authority of a political subdivision to use public |
|
money to provide legal services in a removal proceeding for an |
|
individual unlawfully present in the United States. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 140, Local Government Code, is amended |
|
by adding Section 140.014 to read as follows: |
|
Sec. 140.014. PROHIBITION ON USE OF PUBLIC MONEY TO PROVIDE |
|
CERTAIN LEGAL SERVICES FOR UNLAWFULLY PRESENT INDIVIDUALS. Unless |
|
required by the United States Constitution, a political subdivision |
|
may not: |
|
(1) use public money to provide legal services in a |
|
removal proceeding for an individual who is unlawfully present in |
|
the United States according to the terms of the federal Immigration |
|
and Nationality Act (8 U.S.C. Section 1101 et seq.); or |
|
(2) provide public money to a person to be used to |
|
directly or indirectly provide legal services in a removal |
|
proceeding for an individual described by Subdivision (1). |
|
SECTION 2. This Act takes effect September 1, 2025. |
