A BILL TO BE ENTITLED
 
AN ACT
  relating to reporting by the Texas Education Agency and the
  comptroller on school finance.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 48, Education Code, is
  amended by adding Section 48.011 to read as follows:
         Sec. 48.011.  SCHOOL FINANCE REPORT. (a) Not later than
  December 31, 2025, the agency and the comptroller shall jointly
  prepare and submit to the legislature a report on school finance
  since the state fiscal year beginning September 1, 1994.
         (b)  The report must include for each state fiscal year
  covered by the report:
               (1)  the amount appropriated for school finance for
  that fiscal year from each source of funding, including
  differentiating:
                     (A)  the amount collected from school districts
  under Chapter 49 or former Chapter 41;
                     (B)  amounts disbursed from the Foundation
  Schools Program; and
                     (C)  and amounts disbursed from the state general
  fund;
               (2)  the items for which the money was spent,
  including:
                     (A)  administrative costs, both in total and
  disaggregated by type of cost; and
                     (B)  distribution to school districts and
  open-enrollment charter schools;
               (3)  the amount, if any, transferred to or used for
  another purpose, including each purpose for which the money was
  transferred or used; and
               (4)  the amount, if any, not spent for that fiscal year
  and retained by the agency.
         (c)  This section expires September 1, 2026.
         SECTION 2.  Section 48.273, Subchapter F, Chapter 48,
  Education Code, is amended by adding Subsection (h) to read as
  follows:
         (h)  All reporting pertaining to the Foundation School
  Program and any other education funding shall, regardless of use,
  reflect all funds collected under Chapter 49 or former Chapter 41 as
  "local recapture funding" and be differentiated from "state
  funding" in all reports.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2025.
