A BILL TO BE ENTITLED
 
AN ACT
  relating to the power of a governmental entity to enforce
  compliance with posted speed limits by an automated traffic control
  system.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  The heading to Section 542.2035, Transportation
  Code, is amended to read as follows:
         Sec. 542.2035.  LIMITATION ON AUTOMATED TRAFFIC CONTROL
  SYSTEMS [MUNICIPALITIES].
         SECTION 2.  Section 542.2035, Transportation Code, is
  amended by amending Subsection (a) and adding Subsection (c) to
  read as follows:
         (a)  A governmental entity [municipality] may not implement
  or operate an automated traffic control system with respect to a
  highway or street under its jurisdiction for the purpose of
  enforcing compliance with posted speed limits.  The attorney
  general shall enforce this subsection.
         (c)  In this section, "governmental entity" means this state
  or a political subdivision of this state, including a municipality,
  a county or any kind of district.
         SECTION 3.  This Act takes effect September 1, 2025.
