A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of a municipality to allow a person to |
|
|
file an application to stop a nonconforming use of a property. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 211.019, Local Government Code, is |
|
|
amended by adding Subsection (q) to read as follows: |
|
|
(q) This section does not prohibit a municipality from |
|
|
adopting or enforcing an ordinance, regulation, or other measure |
|
|
that allows a person who resides or owns real property in the |
|
|
municipality to file an application to stop a nonconforming use of a |
|
|
property. |
|
|
SECTION 2. Section 211.019(q), Local Government Code, as |
|
|
added by this Act, applies to an ordinance, regulation, or other |
|
|
measure adopted by a municipality on, before, or after the |
|
|
effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
