A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the award of costs and attorney's fees in an action |
|
|
involving the exercise of certain constitutional rights. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 27, Civil Practice and Remedies Code, is |
|
|
amended by adding Section 27.0091 to read as follows: |
|
|
Sec. 27.0091. COSTS. In any legal action subject to this |
|
|
chapter, the court may award costs and reasonable and necessary |
|
|
attorney's fees as are equitable and just. |
|
|
SECTION 2. Sections 27.007 and 27.009, Civil Practice and |
|
|
Remedies Code, are repealed. |
|
|
SECTION 3. The changes in law made by this Act apply only to |
|
|
an action filed on or after the effective date of this Act. An |
|
|
action filed before the effective date of this Act is governed by |
|
|
the law as it existed immediately before that date, and that law is |
|
|
continued in effect for that purpose. |
|
|
SECTION 4. This Act takes effect September 1, 2025. |
