A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the admission of nonresident undergraduate and graduate |
|
|
students to public institutions of higher education. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter U, Chapter 51, Education Code, is |
|
|
amended by adding Section 51.811 to read as follows: |
|
|
Sec. 51.811. LIMITATION ON ADMISSION OF NONRESIDENT |
|
|
STUDENTS. (a) In this section, "institution of higher education" |
|
|
has the meaning assigned by Section 61.003. |
|
|
(b) Notwithstanding any other provision of this subchapter |
|
|
or Subchapter W but subject to Section 51.803(j), an institution of |
|
|
higher education may not offer admission to undergraduate or |
|
|
graduate students who are not residents of this state for an |
|
|
academic year in excess of the number required to fill 15 percent of |
|
|
the institution's enrollment capacity designated for undergraduate |
|
|
or graduate students, as applicable, for that academic year. |

|
SECTION 2. Section 51.811, Education Code, as added by this |
|
|
Act, applies beginning with admissions for the 2026-2027 academic |
|
|
year. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
