A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to cancellation of certain solid waste disposal permits |
|
issued by the Texas Commission on Environmental Quality. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter C, Chapter 361, Health and Safety |
|
Code, is amended by adding Section 361.1201 to read as fellows: |
|
Sec. 361.1201. CANCELLATION OF CERTAIN LANDFILL PERMITS. |
|
(a) This section applies only to a facility that is located in: |
|
(1) a county with a population of more than 2.1 |
|
million; and |
|
(2) the extraterritorial jurisdiction of the county's |
|
principal municipality with a population of more than 900,000. |
|
(b) The commission shall cancel a permit issued for a |
|
municipal solid waste landfill facility if: |
|
(1) the facility has not accepted waste for a period of |
|
25 consecutive years; and |
|
(2) if the permit was issued to the owner of the |
|
facility, the person to whom the permit was issued no longer owns |
|
the facility. |
|
(c) If the commission cancels a permit under this section, |
|
it may not approve a subsequent permit application for a municipal |
|
solid waste landfill facility that was the subject of the cancelled |
|
permit. |
|
SECTION 2. Section 361.1201(2), Health and Safety Code, as |
|
added by this Act, applies only to the transfer of ownership of a |
|
municipal solid waste facility that occurs on or after the |
|
effective date of this Act. A transfer of ownership that occurred |
|
before the effective date of this Act is governed by the law as it |
|
existed immediately before the effective date of this Act, and that |
|
law is continued in effect for that purpose. |
|
SECTION 3. This Act takes effect September 1, 2025. |
