A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the development of certain regional water plans using |
|
|
safe yield water availability analyses. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 16.053, Water Code, is amended by adding |
|
|
Subsection (e-3) to read as follows: |
|
|
(e-3) When developing a regional water plan under |
|
|
Subsection (e), a regional water planning group for an area that is |
|
|
largely dependent on surface water from one or more reservoirs may |
|
|
evaluate the availability of water from a reservoir based on an |
|
|
analysis of the reservoir's safe yield, expressed in terms of a |
|
|
reduced annual water volume that would continue to be available |
|
|
from the reservoir for a period longer than that of a drought of |
|
|
record. A planning group described by this subsection that decides |
|
|
not to use a safe yield analysis in developing its regional water |
|
|
plan shall provide in its plan an explanation of the reason for that |
|
|
decision. |

|
SECTION 2. This Act takes effect September 1, 2025. |
