A BILL TO BE ENTITLED
 
AN ACT
  relating to the contents of a request for disclosure in a civil
  action brought under the Family Code.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 301.052(a), Family Code, is amended to
  read as follows:
         (a)  A party may request disclosure under Section 301.051 of
  any or all of the following:
               (1)  the correct names of the parties to the action;
               (2)  the name, address, and telephone number of any
  potential parties;
               (3)  the legal theories and, in general, the factual
  bases of the responding party's claims or defenses;
               (4)  the amount and any method of calculating economic
  damages;
               (5)  the name, address, and telephone number of any
  person having knowledge of relevant facts and a brief statement of
  each identified person's connection with the action;
               (6)  for any testifying expert:
                     (A)  the expert's name, address, and telephone
  number;
                     (B)  the subject matter on which the expert will
  testify;
                     (C)  the general substance of the expert's mental
  impressions and opinions and a brief summary of the basis for those
  impressions and opinions, or if the expert is not retained by,
  employed by, or otherwise subject to the control of the responding
  party, documents reflecting that information; and
                     (D)  if the expert is retained by, employed by, or
  otherwise subject to the control of the responding party:
                           (i)  all documents, tangible things,
  reports, models, or data compilations that have been provided to,
  reviewed by, or prepared by or for the expert in anticipation of the
  expert's testimony; and
                           (ii)  the expert's current resume and
  biography;
               (7)  any discoverable settlement agreement described
  by Rule 192.3(g), Texas Rules of Civil Procedure;
               (8)  any discoverable witness statement [settlement]
  described by Rule 192.3(h), Texas Rules of Civil Procedure;
               (9)  in an action alleging physical or mental injury
  and damages from the occurrence that is the subject of the action:
                     (A)  all medical records and bills that are
  reasonably related to the injuries or damages asserted; or
                     (B)  an authorization permitting the disclosure
  of the information described by Paragraph (A);
               (10)  in an action alleging physical or mental injury
  and damages from the occurrence that is the subject of the action,
  all medical records and bills obtained by the responding party
  through an authorization provided by the requesting party; and
               (11)  the name, address, and telephone number of any
  person who may be designated as a responsible third party.
         SECTION 2.  Section 301.052(a), Family Code, as amended by
  this Act, applies to an action that is pending in a trial court on
  the effective date of this Act or that is filed on or after that
  date.
         SECTION 3.  This Act takes effect September 1, 2025.
