A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to access to a child's health records by the child's |
|
parent, managing conservator, or guardian. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 32, Family Code, is |
|
amended by adding Section 32.006 to read as follows: |
|
Sec. 32.006. ACCESS TO CHILD'S TREATMENT RECORDS. Unless |
|
limited by court order, a child's parent or, if applicable, the |
|
child's managing conservator or guardian, is entitled to access to |
|
the child's medical, dental, psychological, or surgical treatment |
|
records, regardless of whether the parent, managing conservator, or |
|
guardian: |
|
(1) was required to consent to the treatment; or |
|
(2) consented to the treatment. |

SECTION 2. Subchapter A, Chapter 181, Health and Safety |
|
Code, is amended by adding Section 181.007 to read as follows: |
|
Sec. 181.007. PARENTAL ACCESS TO MEDICAL RECORDS OF MINOR |
|
CHILD. (a) In this section, "child" means a person younger than 18 |
|
years of age who is not and has not been married or who has not had |
|
the disabilities of minority removed for general purposes. |
|
(b) Nothing in this chapter may be construed to limit the |
|
right of a child's parent or, if applicable, the child's managing |
|
conservator or guardian, to access to the child's health records |
|
under other law. |
|
SECTION 3. This Act takes effect September 1, 2025. |
