A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to liability to a vehicle storage facility operator for |
|
|
money owed in relation to the delivery, storage, and disposal of |
|
|
certain personal property. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 2303.156, Occupations Code, is amended |
|
|
by adding Subsection (c) to read as follows: |
|
|
(c) An insurance company that pays a claim of total loss on |
|
|
personal property stored at a vehicle storage facility is liable to |
|
|
the operator of the facility for any money owed to the operator in |
|
|
relation to delivery of the property to the facility, storage of the |
|
|
property in the facility, and disposal of the property, regardless |
|
|
of whether an amount accrued before the insurance company paid the |
|
|
claim. |
|
|
SECTION 2. Section 2303.156(c), Occupations Code, as added |
|
|
by this Act, applies only to personal property accepted for storage |
|
|
by a vehicle storage facility on or after the effective date of this |
|
|
Act. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
