A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to prohibiting consideration of certain factors regarding |
|
|
student financial assistance by public institutions of higher |
|
|
education. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 56, Education Code, is |
|
|
amended by adding Section 56.010 to read as follows: |
|
|
Sec. 56.010. CONSIDERATION OF CERTAIN FACTORS REGARDING |
|
|
STUDENT FINANCIAL ASSISTANCE PROHIBITED. Notwithstanding any |
|
|
other provision of this code, an institution of higher education |
|
|
may not: |
|
|
(1) award student financial assistance based on race, |
|
|
sex, gender, or sexual orientation; or |
|
|
(2) pay for or advertise student financial assistance |
|
|
awarded based on race, sex, gender, or sexual orientation. |
|
|
SECTION 2. Section 56.010, Education Code, as added by this |
|
|
Act, applies beginning with student financial assistance paid for, |
|
|
advertised, or awarded by a public institution of higher education |
|
|
for the 2026 fall semester. Student financial assistance paid for, |
|
|
advertised, or awarded for a term or semester before the 2026 fall |
|
|
semester is governed by the law in effect on the date on which the |
|
|
student financial assistance was paid for, advertised, or awarded, |
|
|
and the former law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
