A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to prohibiting contracts between certain state agencies |
|
and the Bureau of Alcohol, Tobacco, Firearms and Explosives. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subtitle F, Title 10, Government Code, is |
|
amended by adding Chapter 2278 to read as follows: |
|
CHAPTER 2278. PROHIBITED CONTRACTS WITH CERTAIN FEDERAL AGENCIES |
|
Sec. 2278.001. DEFINITION. In this chapter, "state agency" |
|
means: |
|
(1) a board, commission, department, office, or other |
|
agency in the executive branch of state government that is created |
|
by the constitution or a statute of this state, including a river |
|
authority and an institution of higher education as defined by |
|
Section 61.003, Education Code; |
|
(2) the legislature or a legislative agency; or |
|
(3) the Supreme Court of Texas, the Court of Criminal |
|
Appeals of Texas, a court of appeals, a state judicial agency, or |
|
the State Bar of Texas. |

Sec. 2278.002. CONTRACTS WITH BUREAU OF ALCOHOL, TOBACCO, |
|
FIREARMS AND EXPLOSIVES PROHIBITED. A state agency may not enter |
|
into a contract with the Bureau of Alcohol, Tobacco, Firearms and |
|
Explosives of the United States Department of Justice. |
|
SECTION 2. Chapter 2278, Government Code, as added by this |
|
Act, applies only to a contract entered into on or after the |
|
effective date of this Act. A contract entered into before that |
|
date is governed by the law in effect on the date the contract was |
|
entered into, and the former law is continued in effect for that |
|
purpose. |
|
SECTION 3. This Act takes effect September 1, 2025. |
