A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the prohibited prescription, delivery, administration, |
|
use, advertisement, and solicitation of a COVID-19 vaccine |
|
containing mRNA material. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 161, Health and Safety |
|
Code, is amended by adding Section 161.0086 to read as follows: |
|
Sec. 161.0086. PROHIBITED PRESCRIPTION, DELIVERY, |
|
ADMINISTRATION, OR USE OF COVID-19 VACCINE CONTAINING MRNA |
|
MATERIAL. (a) In this section: |
|
(1) "COVID-19" means the 2019 novel coronavirus |
|
disease. |
|
(2) "mRNA material" means a substance that introduces |
|
messenger ribonucleic acid (mRNA) corresponding to a viral protein. |
|
(b) A person may not prescribe, deliver, administer, or use |
|
a vaccine intended to prevent COVID-19 if the vaccine contains mRNA |
|
material. |
|
SECTION 2. Subchapter B, Chapter 431, Health and Safety |
|
Code, is amended by adding Section 431.0215 to read as follows: |
|
Sec. 431.0215. ADDITIONAL PROHIBITED ACTS. (a) In this |
|
section: |
|
(1) "COVID-19" means the 2019 novel coronavirus |
|
disease. |
|
(2) "mRNA material" means a substance that introduces |
|
messenger ribonucleic acid (mRNA) corresponding to a viral protein. |
|
(b) A person may not advertise or solicit patients for |
|
immunization with a COVID-19 vaccine containing mRNA material. |
|
SECTION 3. This Act takes effect September 1, 2025. |
