A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to certain audits of employers conducted by the Texas |
|
|
Workforce Commission. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 213.055, Labor Code, is amended by |
|
|
adding Subsection (d) to read as follows: |
|
|
(d) The commission may conduct an audit of an employer to |
|
|
determine if the employer is in compliance with the requirements of |
|
|
this subtitle or rules adopted under this subtitle only if the |
|
|
commission has reason to believe that the employer has violated |
|
|
this subtitle or a rule adopted under this subtitle. The commission |
|
|
may not conduct a random audit of an employer for that purpose. |
|
|
SECTION 2. This act takes effect September 1, 2025. |
