A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to public hearings held by the Texas Commission on |
|
|
Environmental Quality in areas that exceed an ambient air quality |
|
|
standard for benzene. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 382, Health and Safety |
|
|
Code, is amended by adding Section 382.0292 to read as follows: |
|
|
Sec. 382.0292. PUBLIC HEARING FOR HIGH LEVELS OF BENZENE. |
|
|
(a) If monitoring or modeling data indicates an area is exceeding |
|
|
or likely exceeding a national or state ambient air quality |
|
|
standard for benzene, the commission shall hold a public hearing in |
|
|
the area to allow interested persons to present comments relating |
|
|
to the elevated levels of benzene. |
|
|
(b) The commission shall provide notice of a public hearing |
|
|
held under Subsection (a) at least once in a newspaper of general |
|
|
circulation in the area in which the hearing is to be held. The |
|
|
notice must be published not later than the 30th day before the date |
|
|
of the hearing. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
