A BILL TO BE ENTITLED
 
AN ACT
  relating to applicability of reporting requirements to private
  schools and other entities providing education services in this
  state that accept students with vouchers, education savings
  accounts, tax credit scholarships, or certain other funding.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 1, Education Code, is amended by adding
  Section 1.0026 to read as follows:
         Sec. 1.0026.  APPLICATION OF REPORTING REQUIREMENTS TO
  CERTAIN PRIVATE SCHOOLS AND OTHER ENTITIES PROVIDING EDUCATION
  SERVICES IN THIS STATE. (a)  In this section, "private school" has
  the meaning assigned by Section 5.001.
         (b)  A private school or other entity providing education
  services in this state that accepts a student with a voucher,
  education savings account, tax credit scholarship, or any other
  funding that would otherwise have been part of the foundation
  school fund is subject to any reporting requirement that applies to
  a school district, the board of trustees of a school district, or
  public school students, including requirements imposed by a state
  agency or entity other than the agency.  A private school or other
  entity subject to reporting requirements under this subsection
  shall provide a report required in accordance with this section not
  later than the 30th day after the date on which a public school must
  provide the same report.
         (c)  A private school or other entity providing education
  services in this state may not enroll or otherwise provide
  education services to students described by Subsection (b) in any
  school year in which the private school or other entity providing
  education services does not comply with this section.
         SECTION 2.  This Act applies beginning with the 2025-2026
  school year.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2025.
