A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to applicability of reporting requirements to private |
|
schools and other entities providing education services in this |
|
state that accept students with vouchers, education savings |
|
accounts, tax credit scholarships, or certain other funding. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 1, Education Code, is amended by adding |
|
Section 1.0026 to read as follows: |
|
Sec. 1.0026. APPLICATION OF REPORTING REQUIREMENTS TO |
|
CERTAIN PRIVATE SCHOOLS AND OTHER ENTITIES PROVIDING EDUCATION |
|
SERVICES IN THIS STATE. (a) In this section, "private school" has |
|
the meaning assigned by Section 5.001. |
|
(b) A private school or other entity providing education |
|
services in this state that accepts a student with a voucher, |
|
education savings account, tax credit scholarship, or any other |
|
funding that would otherwise have been part of the foundation |
|
school fund is subject to any reporting requirement that applies to |
|
a school district, the board of trustees of a school district, or |
|
public school students, including requirements imposed by a state |
|
agency or entity other than the agency. A private school or other |
|
entity subject to reporting requirements under this subsection |
|
shall provide a report required in accordance with this section not |
|
later than the 30th day after the date on which a public school must |
|
provide the same report. |
|
(c) A private school or other entity providing education |
|
services in this state may not enroll or otherwise provide |
|
education services to students described by Subsection (b) in any |
|
school year in which the private school or other entity providing |
|
education services does not comply with this section. |
|
SECTION 2. This Act applies beginning with the 2025-2026 |
|
school year. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2025. |
